This is an individual assessment.
That said, this assessment is associated with CLO2 of this subject, which is as follows:
“Demonstrate understanding on the structures and jurisdictions of the Malaysian legal and judicial system, substantive law and procedural law, separation of powers, common law, civil law, public law and private law, engineering contract and tort.”
The following instructions, and a rubrics chart in another document, show the structure that is expected in the submission for this assessment.
Instructions:
1. Softcopy Only: The report should be in softcopy form, e.g. Word and PDF, that can be uploaded. This is a must.
Also, since this is an assessment with a long duration (long enough for students to learn to prepare a digital document), submissions with snap-photos of handwritten work are not acceptable. The first entry in the rubrics chart is about the use of word-processing software and other software for the submission.
2. Dissimilarity: There is a rubric entry on dissimilarity with other submissions. This one grades the uniqueness of a student’s submission. See the descriptions in Evaluation Rubrics for details.
3. Submission on Time: This should be self-explanatory.
Items no. 4 to 8 concern details that must be provided in the submission.
4. Specific Engineering Practice: A specific engineering practice must be the topic of the case study; this can be an engineering-oriented industry, economic sector or any other endeavour that is dependent on engineering.
5. Example Case: Legal cases can occur in any engineering practice. The circumstances of the legal cases involve things about the engineering practice, such as its work procedures, regulations on materials that are used, et cetera. In other words, the example case must be related to engineering.
The following is an example of a case that is not associated with the practice: an engineer goes home from the engineering firm at the end of a workday and is involved in a traffic accident. Such a case can occur for anyone that is going home from work.
6. Jurisdiction Involved: Every legal case requires arbitration. This arbitration can be provided by courts or any other legal body that can be a neutral third party. However, the arbitrator must have the authority to hear this case and issue decisions that the parties involved must follow; this is especially important for engineering-related cases, which often involve many people. Therefore, the legal case that is mentioned must be under a specified jurisdiction. There could be other possible jurisdictions too, for complicated cases, but separation of powers means that only one or a few would be chosen to hear this case.
7. Relevant Laws: Engineering-related activities involve many people, e.g. public utilities that deliver water and electricity to homes and workplaces. Therefore, communities and society are affected by such activities, so substantive laws will be involved when there are legal cases about engineering. Engineering-related activities also involve practical methodologies and working steps, so procedural laws will be involved in such cases. The types of substantive and procedural laws involved in the case must be mentioned, together with the citations of specific laws.
8. References: Any document that is engineering-related should have citations of references regarding matters like technical specifications, methodologies and in the case of this subject, any similar cases that could be used as precedents. These are not the only examples of references.
Items 9 to 10 concern the quality of the submission’s presentation:
9. Text: The text in the submission should be originally written, readable/legible, logically and reasonably understandable, and relevant to the proposal details.
10. Other Methods of Presentation: Although methods of presentation other than text is not strictly needed for legal dissertations (like any submission for this assignment), engineering-related legal cases will involve technical things that may not be automatically clear to anyone that does not have an engineering background.
Therefore, there must be other methods of presentation, e.g. illustrations, diagrams, tables and Gantt charts to explain technical facts in the case. Expected uses for these include any mixture of the following:
- Illustrations for a visual imagery of technical processes that are involved in the case.
- Diagrams, e.g. process flowcharts or network diagrams, to show process sequences or other logical progression of engineering-related activities that are relevant to the case.
- Tables to show data that has been tabulated and recoded and which is relevant to the case.
- Gantt charts to show timeline of events in the engineering activity that is involved in the case, if the activity is a long-term project.
